Prevention of Illegal Health Mandates

Prevention of illegal health mandates during Covid was the purpose and impetus for the launch of the national Right to Refuse project. Concerns included mandates regarding masking, social distancing, vaccination requirements for employment or education, family visitation of sick relatives, business closures, community functions and gatherings, and more.

  • Health care providers may not refuse care based on vaccine status in 4 states: New Hampshire, North Dakota, Texas, West Virginia

  • Broad Medical Freedom Act: Idaho

  • Right to visitors at a healthcare facility: Idaho, Louisiana

  • Child’s vaccine status protected in family court: Idaho, Montana

  • No unwanted genetic procedures (mRNA): Utah

  • Death certificates to include vaccine status: North Dakota

  • The World Health Organization and the United Nations have no jurisdiction: Louisiana, Oklahoma, Idaho

  • In addition to the 93 new Right to Refuse laws passed, 8 Resolutions were passed by 7 legislatures opposing federal overreach and federal vaccine mandates: Alabama, Idaho, Michigan, North Dakota, Ohio, Tennessee, Wyoming

State Police Power v. Constitutional Individual Personal Freedom

Each state has the authority to protect its own citizens under its state constitution and police power. But during Covid the clash between state police power and constitutional individual personal freedoms and bodily autonomy took center stage, not only in our country but around the world. Citizens gathered to protect their personal freedoms. And in our country citizens advocated for introduction of “first of its kind” state bills to prevent emergency health measures from taking away health freedoms.

Cutting edge lawsuits were also filed to discern the constitutional issues of whether any government has the authority to declare an emergency and then take away the freedom of its people. Health mandates represented the antithesis of what it means to be an American and courts were challenges to protect constitutional freedoms. New case law emerged throughout the country protecting health freedom.

By working together, we can protect our freedoms and have a limited government that provides adequate information and protection without infringing on our constitutional rights of bodily autonomy.
